Terms of service

These terms are an agreement between you and NFound Samaritan Project, a nonprofit organisation based in California, United States ("NFound", "we"). By creating an account, publishing a report, buying a tag, donating, or otherwise using the NFound app or website, you accept them. If you do not accept them, do not use NFound.

1. What NFound is

NFound helps people report and find lost or found pets, people and belongings, share live location within groups they choose, talk to each other, raise an SOS to people they trust, and buy physical NFound tags. NFound is a community service run by a nonprofit. It is not an emergency service. If someone is in danger, call your local emergency number first.

2. Your account

You must be 13 or older. You sign in with a phone number you control and are responsible for what happens under your account. Tell us at once if you think it has been used by someone else. One person, one account; staff may remove duplicate, abusive or fake accounts.

3. What you post

You keep ownership of what you post. You give NFound a licence to store, display and distribute it as the service requires (a public report is public). You confirm that:

• - reports are truthful and about a real lost or found pet, person or item;
• - you have the right to share any photo, and any person in it;
• - you will not post anything unlawful, threatening, harassing, discriminatory, sexual, or that reveals someone's private details without their consent;
• - you will not use NFound to track a person who has not agreed to be tracked, to stalk, or to locate someone against their will;
• - you will not raise a false SOS, and you will not add someone as an emergency contact who has not agreed to it.

We may remove content and suspend or close accounts that break these rules, and we may report unlawful behaviour to the authorities.

4. Location sharing and SOS

Sharing your live location, saving your route and raising an SOS are choices you make in the app, per group and per event. You can stop them at any time. Group members can see what you share with that group. An SOS is delivered on a best-effort basis: text messages, push notifications and internet connectivity can fail, and NFound does not guarantee that anyone will respond. Volunteers are other users who chose to help; they are not employees, are not vetted, and act at their own discretion and risk. Do not rely on NFound instead of emergency services.

5. Tags, orders, shipping and refunds

Prices are shown in USD at checkout. An order is accepted when payment clears. We ship to the countries listed at checkout, within the delivery time shown; delivery dates are estimates. If we cannot ship (for example, an item sold out before payment cleared), we will refund you in full. You may cancel an unshipped order for a full refund from the app. Shipped tags can be returned within 30 days if unused, at your postage cost, for a refund of the item price. Faulty tags are replaced or refunded, postage included. Payments are processed by Stripe; if you dispute a charge with your card issuer, contact us first — most problems are quicker to fix directly.

Tags are a way for a finder to reach you. They depend on the finder having a camera and internet access and on you keeping the contact details on the tag current.

6. Donations

Donations are voluntary gifts to the project and are not refundable except where the law requires or where a payment was made by mistake — contact us within 14 days. If you need a receipt for tax purposes, write to help@nfound.org and we will tell you what we can issue.

7. Calls and messages

Calls are carried by LiveKit and are not recorded by NFound. Messages are stored so the conversation can be read by its participants. Do not use calls or messages to harass anyone; blocking a user stops their calls and messages to you.

8. Our service

We work hard to keep NFound running but provide it as is, without warranties. We may change, suspend or discontinue features, and we will give notice where we reasonably can. We may require you to update the app to keep using it. To the fullest extent the law allows, NFound and its volunteers are not liable for indirect, incidental or consequential loss, for loss of a pet, person or item, for the acts of other users or volunteers, or for anything beyond our control; our total liability for any claim is limited to the amount you paid us in the 12 months before it arose (or USD 100 if you paid nothing). Nothing here limits liability that cannot be limited by law.

9. Ending things

You can delete your account at any time in Settings. We can suspend or terminate accounts that break these terms or the law, or where required to protect people. Sections 3, 8, 9 and 10 survive termination.

10. General

These terms are governed by the laws of the State of California, United States; disputes go to the state and federal courts located in California, unless the law where you live gives you other rights. If a part of these terms is unenforceable, the rest stands. We may update these terms; material changes are announced in the app before they apply, and continued use means acceptance.
